Retailer Agreement

There are two types of agreements used for the commercial movement of midge tolerant wheat seed:

  1. Midge Tolerant Wheat Retailer Agreement – used when you sell to retailers
  2. Midge Tolerant Wheat Stewardship Agreement – used when you sell to farmer customers

Before anyone can be a midge tolerant wheat retailer they must complete the midge tolerant wheat Retailer Training to receive their Midge Tolerant Wheat Authorized Retailer Number. This unique retailer number will be assigned when they successfully pass the midge tolerant wheat online quizzes.  

If you plan to wholesale midge tolerant wheat seed you must have the retail company or individual who plans to sell the seed sign a Midge Tolerant Wheat Retailer Agreement (remember they must have a Midge Tolerant Wheat Authorized Retailer Number as described above). In effect this agreement states that they (the retailer) will assume responsibility to have the farmer customer sign the Midge Tolerant Wheat Stewardship Agreement and report that customer’s sales volume.

Examples of when the Midge Tolerant Wheat Retailer Agreement must be signed:

  1. A seed producer grows a midge tolerant wheat variety and wishes to sell wholesale Certified seed to another member or another company. The seed producer has the wholesale purchaser sign a Midge Tolerant Wheat Retailer Agreement. The retailer is now responsible for the submission of stewardship agreements for all the seed that they sell.
  2. If the retailer wants to sell wholesale to another retailer (or seed producer) they would sign a second Retailer Agreement with the second retailer (or seed producer). This agreement moves the responsibility for this seed to the second retailer. This may occur several times until the seed is ultimately sold to a farmer customer. At the time the seed is sold to a farmer customer a Midge Tolerant Wheat Stewardship Agreement must be signed.
  3. A seed producer wishes to sell direct to a farmer customer. This may seem strange, but in order to make this process work, the seed producer needs to sign an agreement with himself - since he is wholesaling Certified seed to himself.   This means each seed producer must complete the midge tolerant wheat retailer training modules and obtain a Midge Tolerant Wheat Authorized Retailer Number. This will allow the database to track the production and movement of the seed. Fortunately you only have to sign this Retailer Agreement with yourself once! You can then proceed to sell to farmer customers using the Midge Tolerant Wheat Stewardship Agreement.

In each case, as the Retailer and Stewardship Agreement forms are signed, they must be faxed to the Midge Tolerant Wheat Stewardship Resource Centre at 866-222-7613 or a scanned copy emailed to mtw@agdata.com.
